1. What this warranty covers
Safer Lighting Inc. (operating saferlighting.ca, the "Company") warrants every LED product sold through this site against defects in materials and workmanship for a period of five (5) years from the date of original purchase by the first end user (the "Warranty Period").
Covered LED products include, without limitation: recessed pot lights, slim panel downlights, flush-mount panels, vanity bars, LED flat panels, high-bay fixtures, linear strip lights, wall packs, flood lights, parking-lot shoeboxes, and integrated commercial linear fixtures.
2. What the warranty entitles you to
If a covered LED product fails during the Warranty Period as a result of a defect in materials or workmanship, and the failure is verified by us, the sole remedy available is:
- Replacement with the same product or, if the same SKU is no longer manufactured, a comparable substitute of equal or greater specification, selected at our sole discretion, at no charge.
No monetary refunds are issued under this warranty under any circumstances. Replacement is the exclusive remedy. Replacement labour is provided as described in section 3.
3. Replacement labour coverage
Every covered LED product carries a 5-year warranty on the product against defects in materials and workmanship. In addition, for the first twelve (12) months from the date of original purchase, Safer Lighting also covers replacement labour for verified defect claims at installation addresses within our sister company Safer Electric Inc.'s service area in the Greater Toronto Area (GTA) (ESA Licence #7008996). During this one-year labour period, Safer Lighting will arrange and pay for a licensed electrician from Safer Electric to remove the failed unit and install the replacement at no charge to you.
This applies whether or not Safer Electric performed the original installation, provided the original installation was performed by a licensed electrician in accordance with the Ontario Electrical Safety Code and the manufacturer's instructions.
After the first year (years 2 through 5)
For verified defect claims made after the first twelve (12) months and within the remaining five-year product warranty period, Safer Lighting will ship a free replacement unit to you. The cost and arrangement of installation through a licensed electrician is your responsibility. No labour coverage is provided for claims made after the first year from the date of original purchase.
Outside the Safer Electric service area (first year)
If your installation address is outside Safer Electric's service area during the first-year labour period, we will ship a free replacement unit to you. Arrangement and cost of installation through a licensed electrician is entirely your responsibility. No labour reimbursement is provided for out-of-area claims.
4. Who can make a claim
The warranty is extended to the original end-user purchaser and is transferable to subsequent owners of the same property for the remainder of the original Warranty Period, provided proof of original purchase is presented. A copy of the original order confirmation, invoice, or contractor receipt issued by Safer Lighting is required to validate any claim.
5. What is not covered
This warranty covers manufacturing defects only. It does not cover damage or failure caused by anything the customer does, installs incorrectly, or exposes the product to. Specifically, this warranty does not cover, and the Company will not be liable for, any of the following:
- Physical damage of any kind, including but not limited to cracks, dents, broken housings, bent frames, shattered lenses, and any damage resulting from dropping, impact, mishandling, or improper storage during or after installation.
- Liquid or moisture damage, including water ingress, condensation, flooding, irrigation spray, or any moisture exposure on a fixture not rated for that environment. A product installed in a wet or damp location without the appropriate IP or wet-location rating is not covered.
- Damage resulting from installation that does not comply with the Ontario Electrical Safety Code or the manufacturer's published installation instructions.
- Damage resulting from operating the product outside its rated input voltage, ambient operating temperature, IP rating, or wet/damp/dry-location rating as published on the product spec sheet.
- Damage caused by power surges, lightning strikes, voltage spikes, or unstable power supply.
- Damage caused by accident, vandalism, fire, flood, freezing, smoke, chemical exposure, salt spray (in non-marine-rated fixtures), pest activity, or any other external casualty event.
- Cosmetic wear that does not affect function, including but not limited to scratches, minor finish discoloration after three (3) years on outdoor fixtures, and gasket aging.
- Products that have been modified, repaired, opened, or had any internal parts substituted by any party other than the Company or the original equipment manufacturer.
- Products sold as "final sale", "clearance", "as-is", "open-box", "B-stock", or "scratch and dent". The reduced or zero warranty period for these items is disclosed at the time of sale on the product page.
- Consumable items (e.g., LED bulbs sold as replacement lamps separately from a fixture body), which carry the manufacturer's standard consumable warranty as labelled on the packaging.
- Non-LED items, including but not limited to wire, cable, breakers, panels, devices, conduit, fittings, and tools, which carry the original equipment manufacturer's warranty as published with the product.
- Indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to lost profits, lost business, business interruption, or loss of use of property.
If we determine that the cause of failure falls into any of the categories above, no replacement will be issued. Our determination is final.
6. How to file a claim
- Contact Safer Lighting within the Warranty Period by phone at 905-451-LEDS (5337) or by email at warranty@saferlighting.ca. Have your order number and a description of the failure ready.
- Provide photographs or a short video of the failed unit, ideally in place, showing the product, the failure mode, and any visible model or serial number on the fixture.
- We will confirm whether the claim is covered, typically within two (2) business days.
- For covered claims within our service area, we ship the replacement and schedule a service call with our licensed electrician at a time convenient for you. For covered claims outside our service area, we ship the replacement unit at no charge.
- Most claims are resolved within five (5) business days of submission.
You are not required to ship the failed unit back to us before a replacement is sent. Our electrician collects the failed unit at the time of installation, or you may return it to our Brampton warehouse afterwards.
7. Limitation of remedies
Product replacement as described in section 2 is your sole and exclusive remedy under this warranty. No refunds, credits, labour reimbursements, or monetary compensation of any kind will be issued. The Company's total liability under this warranty is strictly limited to the cost of the replacement product.
To the maximum extent permitted by law, the Company disclaims all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, except to the extent that such implied warranties cannot be disclaimed under the consumer-protection laws of the province in which the product was purchased.
Where applicable consumer-protection law gives you rights that cannot be disclaimed (for example, certain mandatory protections under the Consumer Protection Act, 2002 (Ontario)), this warranty is in addition to, and does not replace, those statutory rights.
8. Definitions
- Service areaSafer Electric Inc.'s standard travel radius from its Brampton, Ontario operating address as published from time to time on saferelectric.ca. As of the effective date of these terms, the service area covers the Greater Toronto Area and extends to all addresses within approximately 100 kilometres of 18 Strathearn Avenue, Unit 6B, Brampton, Ontario.
- Original purchaserThe first end user, individual or business, to whom the product was sold by Safer Lighting (either directly through saferlighting.ca, or in person at the Brampton showroom).
- Defect in materials or workmanshipA failure of the product to perform substantially in accordance with its published specifications when operated under the conditions for which it is rated, where the failure is attributable to the manufacture of the product and not to external factors listed in section 5.
- Licensed electricianAn individual holding a valid Certificate of Qualification as an Electrician (309A or 309C) issued by the Province of Ontario and currently employed by, or operating as, an ESA-licensed Electrical Contractor in good standing.
9. Governing law and jurisdiction
These warranty terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising out of or relating to this warranty will be brought in the courts of the Province of Ontario sitting at Brampton, and the parties consent to the exclusive jurisdiction of those courts, subject only to the rights of either party to enforce a judgment in another jurisdiction.
10. Severability and entire agreement
If any provision of these warranty terms is found to be unenforceable, the remaining provisions remain in full force and effect. These warranty terms, together with the Company's Terms of Service, constitute the entire agreement between the Company and you with respect to the warranty of the covered LED products and supersede any prior or contemporaneous oral or written representations.
11. Updates
The Company may update these warranty terms from time to time. Any update applies only to products purchased after the effective date of the update. The warranty in effect at the time of your original purchase continues to govern your covered products for the remainder of their Warranty Period.
