Terms of Service

These Terms of Service ("Terms") govern your use of the Safer Lighting Inc. website at saferlighting.ca and any purchases made through it. By accessing our website or placing an order, you agree to these Terms. These Terms do not limit any rights you have under applicable consumer protection legislation, including the Ontario Consumer Protection Act, 2002 and the Sale of Goods Act, R.S.O. 1990.

1. About Us

Safer Lighting Inc. is a division of Safer Electric Inc., a licensed electrical contractor (ESA/ECRA Licence #7008996) based in Brampton, Ontario, with over 30 years of electrical industry experience and more than 15 years serving the Greater Toronto Area market. We sell commercial and residential LED lighting products to consumers and electrical contractors across Canada.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract under Ontario law to place an order. By placing an order, you represent that you meet this requirement.

3. Orders and Pricing

All prices are in Canadian dollars (CAD) unless otherwise stated. Prices are subject to change without notice prior to order confirmation. We reserve the right to cancel or refuse any order at our discretion, including for pricing errors. If we cancel a confirmed order, we will issue a full refund within 5 business days.

Volume and contractor-tier pricing is subject to the account terms established at the time of account approval. See Section 10 for final-sale rules applicable to contractor pricing tiers and clearance items.

4. Internet Agreement Disclosures (Ontario CPA, ss. 38–40)

As required by the Ontario Consumer Protection Act, 2002 for internet agreements, we confirm the following before you complete your purchase:

  • Supplier name and address: Safer Lighting Inc. (a division of Safer Electric Inc.), 18 Strathearn Ave, Brampton, ON L6T 4L8. Email: info@saferlighting.ca. Phone: (905) 451-5337.
  • Description of goods: As listed on each product page at the time of order.
  • Itemized pricing: Displayed at checkout including HST (13% in Ontario) and applicable shipping charges.
  • Currency: Canadian dollars (CAD).
  • Payment methods accepted: Visa, Mastercard, American Express, Shop Pay, Apple Pay, Google Pay. Payment is processed via Shopify Payments (Stripe) at checkout.
  • Delivery: Estimated shipping timelines are shown at checkout. See Section 6.
  • Cancellation and return rights: See our Refund Policy and Section 10 below. Consumer customers retain all rights under the Ontario CPA including internet agreement cancellation rights under s. 40.
  • Warranty: See our Warranty Terms.

A copy of your order confirmation (which constitutes the written copy of this internet agreement under s. 39 of the CPA) is automatically emailed to the address you provide at checkout within minutes of placing your order.

5. Statutory Consumer Rights — Not Limited by These Terms

Nothing in these Terms limits, restricts, or waives any right you may have under:

  • The Ontario Consumer Protection Act, 2002, including the right to cancel an internet agreement within one year if required pre-contract information was not provided, and implied warranty rights under s. 9 (which cannot be excluded for consumer sales)
  • The Ontario Sale of Goods Act, R.S.O. 1990, including implied conditions of merchantability (s. 14) and fitness for purpose (s. 15), which apply to consumer sales and cannot be excluded by contract (CPA s. 9(2))
  • Any other applicable federal or provincial consumer protection legislation

If any provision of these Terms conflicts with a mandatory statutory right, the statutory right prevails to the extent of the conflict.

6. Shipping and Delivery

We ship within Canada. Estimated delivery times are provided at checkout and are not guaranteed. Risk of loss and title pass to you upon handover to the carrier. If your order arrives visibly damaged, you must report it to us within 48 hours of delivery by emailing info@saferlighting.ca with photos. Failure to report within 48 hours may limit your ability to make a transit-damage claim against the carrier, though it does not affect your statutory warranty rights against us.

7. Limitation of Liability

To the maximum extent permitted by applicable law (and subject always to Section 5 above), our total liability to you for any claim arising from your purchase is limited to the purchase price you paid for the product giving rise to the claim.

Important regarding electrical products: Our products are electrical goods. Exclusions of consequential damages do not apply to personal injury or property damage caused by a product defect, to the extent such exclusions are prohibited by the Ontario Consumer Protection Act or other applicable law. This limitation of liability does not waive your right to seek compensation for losses caused by defective products through applicable legal channels, including against our product liability insurer.

We are not liable for losses caused by: (a) installation not performed by or under the supervision of a licensed electrician; (b) use of our products outside their rated specifications; (c) modifications to the product after delivery; or (d) events described in Section 11 (Force Majeure).

8. Intellectual Property

All content on saferlighting.ca — including product images, descriptions, brand assets, and the site design — is the property of Safer Lighting Inc. or its licensors. You may not reproduce, republish, or redistribute any content without our prior written consent.

9. User Accounts

Contractor and wholesale accounts on saferinventory.com are subject to separate account terms provided at registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

10. Final Sale Items — Point-of-Purchase Disclosure

The following product categories are designated final sale and are not eligible for return or exchange except for defects covered under warranty:

  • Contractor-tier / volume-priced orders: Products purchased under approved contractor account pricing at volume-tier rates are final sale. This designation is displayed on the product page and at checkout for any qualifying item.
  • Clearance and discontinued items: Products marked "Clearance" or "As-Is" are final sale and are not covered under our standard warranty unless a defect is identified within 30 days of delivery.
  • Custom or special-order products: Items ordered to specification (custom colour temperature, non-standard wattage, project-specific quantities above 20 units) are final sale once the order is confirmed.

If a final-sale designation applies to your order, it will be clearly shown on the product listing page, in your cart, and on the order confirmation email before you complete payment. This disclosure satisfies the Ontario CPA requirement for point-of-purchase disclosure of material limitations on return rights.

11. Force Majeure

Safer Lighting will not be liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, pandemics, government orders or restrictions, port closures, carrier strikes or disruptions, manufacturer supply chain failures, or power outages. In any such event, we will: (a) notify you promptly by email; (b) use commercially reasonable efforts to resume performance as soon as practicable; and (c) offer you the option to cancel your unshipped order for a full refund if the delay exceeds 30 days.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without reference to conflict of law principles. Any dispute arising from these Terms or your purchase will be subject to the exclusive jurisdiction of the courts of Ontario. Nothing in this clause limits your right to seek remedies through the Ontario Consumer Protection Branch, the Better Business Bureau, or any other applicable regulatory body.

13. Modifications

We may update these Terms from time to time. The updated Terms will be posted on this page with a revised effective date. For purchases already completed, the Terms in effect at the time of purchase govern. For future purchases, continued use of our website after the updated effective date constitutes acceptance.
